The ground rules for using Scorpion Alert. We kept the language plain so you can actually read it.

These Terms & Conditions ("Terms") govern your use of the Scorpion Alert website, mobile apps, the Scorpion Detector hardware, and the monitoring service (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

The Service

Scorpion Alert provides UV-lit Scorpion Detectors and a cloud monitoring service that delivers push alerts to your phone when a Detector identifies a potential scorpion. The Service is a detection and awareness tool — it is not extermination, pest control, or a substitute for professional medical or pest-management advice. A Detector may miss a scorpion, and an alert may be triggered by something other than a scorpion. Do not rely on the Service as the sole safeguard for anyone who could be seriously harmed by a scorpion sting.

Accounts

You are responsible for the accuracy of the information you provide when you register and for keeping your login credentials secure. Tell us right away if you suspect someone has accessed your account without your permission.

Hardware: rental, return, and lost-equipment fee

The Scorpion Detector is provided on a rental basis under a monthly subscription. You retain physical possession while the subscription is active. The Detectors remain the property of Scorpion Alert at all times.

How to cancel. Cancellations can only be initiated by emailing support@scorpionalert.com. We will reply with return instructions. To complete cancellation, you must return all Detectors associated with your account to Scorpion Alert at your own expense. Cancellation is not finalized — and your subscription will continue to bill on its normal schedule — until we receive the returned Detectors in reasonable condition.

Non-return fee. If we have not received your returned Detectors within 30 days after you initiate cancellation, your account will be charged a non-return fee of $20 per Detector that has not been returned. The non-return fee is a lost-equipment charge in lieu of the hardware itself; payment of the fee discharges your obligation to return that Detector. You authorize us to collect the non-return fee through the payment method on file or through any other lawful means.

Condition on return. Detectors must be returned in reasonable condition — normal wear is fine. Water damage, physical destruction, missing components, or other damage caused by misuse may result in additional charges up to the non-return fee per affected Detector.

Subscription and billing

The monitoring subscription renews automatically each billing period until cancelled. Prepaid periods are not refunded on a pro-rated basis when you cancel mid-period; you will retain access through the end of the period for which you have already paid. You authorize us to charge your saved payment method for each renewal until your cancellation is finalized as described in the Hardware section above. If a charge fails, we may suspend the Service and seek payment by other lawful means.

Acceptable use

You agree not to: (a) resell, sublicense, or redistribute the Service; (b) reverse engineer, tamper with, or attempt to extract credentials from the Detector firmware or cloud service; (c) use the Service to harass, defraud, surveil unlawfully, or impersonate anyone; or (d) use the Service in a way that violates applicable law.

Privacy and detection data

Detectors capture photographs when motion or fluorescence triggers a detection event. These images are transmitted to our cloud service for AI verification and made available to you in the app. By installing a Detector, you represent that you have the right to monitor the location where it is placed, and you are responsible for complying with any applicable privacy or notice requirements relating to other people who may enter that area. Our handling of personal data is described in the Privacy Policy.

Intellectual property

All content, software, firmware, Detector designs, trademarks, and the Scorpion Alert name are owned by Scorpion Alert or our licensors and are protected by intellectual property law. The Service is licensed, not sold. Patent pending.

Property and installation — your responsibility

You decide where and how to install your Detectors. You are solely responsible for the condition and capacity of the electrical outlets you use, the suitability of the installation environment (humidity, temperature, exposure to liquids, proximity to flammables or finished surfaces), and any supervision of the equipment in use.

To the maximum extent permitted by law, Scorpion Alert is not responsible for any damage to real or personal property — including but not limited to electrical systems, outlets, fixtures, finishes, walls, flooring, furnishings, or contents — arising out of or related to your installation, use, or environment for the Detectors, regardless of the cause. If you are uncertain whether a particular outlet or location is suitable, consult a qualified electrician before installing a Detector there.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or will detect every scorpion that enters your home. Some jurisdictions do not allow the exclusion of certain implied warranties; in those jurisdictions, the foregoing exclusions apply to the extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Scorpion Alert and its officers, employees, and suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Scorpion Alert and its officers, employees, and suppliers from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) your installation or use of the Detectors, including any damage to persons or property at your premises or at any other location where you place a Detector, or (c) any content you submit to the Service.

Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we make material changes to the Terms, we'll update the "Last updated" date above and, for account holders, notify you in the app. Continuing to use the Service after an update means you accept the revised Terms.

Termination

To close your account, email support@scorpionalert.com. Account closure is subject to the return obligation in the Hardware section above. We may suspend or terminate access if you violate these Terms or fail to pay amounts when due. On termination, your right to use the Service ends and rentable hardware must be returned (or paid for as a non-return fee).

Resolving disputes informally first

Before filing a claim in court, please email support@scorpionalert.com with a description of your concern so we have a chance to address it directly. We will use reasonable efforts to resolve any dispute within 60 days of receiving your message. Most issues can be settled this way without anyone needing a lawyer.

Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service that is not resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

General

These Terms, together with our Privacy Policy and any policies we link to from within the Service, are the entire agreement between you and Scorpion Alert regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

We may assign these Terms to a successor in connection with a merger, acquisition, or sale of substantially all of our assets; you may not assign these Terms without our written consent. Neither party is liable for delay or failure to perform due to causes beyond its reasonable control (such as natural disasters, power or network outages, supplier failures, or government action). All notices to you may be given by email to the address on your account or by in-app notification, and are effective when sent.

The Service is intended for use by individuals in the United States; we make no representation that the Service is appropriate or available outside the United States.
